Applying law to the facts is the whole game
Most marks sit in problem questions that apply legal rules and relevant case law to a specific set of facts. State the law correctly but never actually apply it to the scenario in front of you, and you've earned yourself only a fraction of the marks available.
A case name alone isn't worth much
Citing a case correctly matters less than explaining what legal principle it establishes and why that principle applies to these particular facts. A list of case names with no explanation of their significance reads exactly like what it is: memorisation without understanding.
Structuring a problem question
Identify the legal issue raised by the facts before you launch into rules. State the relevant rule, backed by statute or case law. Apply that rule explicitly to the facts you've been given, not a generic version of the scenario. Then reach a conclusion about the likely outcome, and be honest where real uncertainty exists.
Where marks quietly disappear
Watch for stating the law without ever applying it to the facts, citing cases without explaining what makes them relevant, and criticising a rule with no specific legal reasoning or authority behind it.
